UNDATED (WKRC) - A class action lawsuit has been filed against On, a popular sneaker brand, alleging that some of its shoes equipped with "CloudTec" technology produce an "embarrassingly loud" squeak when worn.
The lawsuit, filed on Oct. 9, targets at least 11 sneaker styles, including the Cloud 5, Cloud 6, CloudMonster, and Cloudrunner, according to AOL.
According to the plaintiffs, the "CloudTec" technology, designed to "provide cushioned support when wearers land," instead causes components to "rub together," resulting in a "noisy and embarrassing squeak with each and every step."
While the lawsuit acknowledges that the squeaking may seem "seemingly inconsequential," it claims that On has refused to offer refunds, leaving customers with "no relief after buying almost $200 shoes they can no longer wear without their doing significant DIY modifications to the shoe."
The suit argues that "no reasonable consumer would purchase Defendant's shoes -- or pay as much for them as they did -- knowing each step creates an audible and noticeable squeak."
The plaintiffs were seeking "compensatory, statutory, and punitive damages" along with refunds, citing "fraudulent business practices" and a "deceptive marketing scheme" as the basis for their "ascertainable loss."
