The Kumasi high court has ruled that Akosua Serwaa cannot be recognised as the only lawful spouse of the late highlife legend Daddy Lumba.

The judgment, delivered by Justice Dorinda Smith Arthur (PhD), found that Akosua Serwaa had failed to prove that she had a valid civil marriage with the musician.

The court said that although Akosua Serwaa submitted a marriage certificate from Germany, issues were raised over its authenticity and admissibility.

The court held that their union amounted only to a customary marriage. By this finding, Akosua Serwaa's claim to be the sole surviving wife and to enjoy exclusive rights as the widow of Daddy Lumba was dismissed.

In the same ruling, the high court affirmed that Priscilla Ofori, popularly known as "Odo Broni", is legally recognised as a spouse of Daddy Lumba under customary law.

This recognition grants her the rights due a surviving wife under Ghanaian customary law.

Earlier, Akosua Serwaa had filed for an injunction to stop the funeral and burial rites for Daddy Lumba, arguing that only she was the lawful widow.

The high court dismissed that injunction in late October, ruling against restraining the family from proceeding with plans for the musician's burial, scheduled first for 6 December 2025 and then rescheduled to 13 December.

The court sad it based its decision on what was "just and convenient", noting that Akosua Serwaa had not met the legal burden required to block the funeral.

Justice Smith-Arthur also criticised the practice of performing both civil (ordinance) and customary marriages for the same couple, calling it "wasteful".

Under Ghanaian law, she explained, each form of marriage is independently valid, making dual ceremonies unnecessary.
