Dalhart ISD explains how Texas HB 12 gives parents more rights, can limit educators

DALHART, Texas (KFDA) - Texas House Bill 12 is now a law and Dalhart ISD explains how it gives parents more rights to their children in public schools, but can limit educators.

The bill requires school districts to obtain permission through consent forms from parents.

The consent form is to give permission to students to participate in any club or school sanctioned activity.

This also includes consent before any mental or physical health services can be provided.

"You know they tell us they want our counselors providing more behavioral, social, mental illness, well-being for our students, but if parents don't fill this form out, then our counselors can't meet and assist the kids," says Dalhart Superintendent Jeff Byrd.

Byrd says he believes the bill was written in good faith but put limits on nurses and counselors, if a consent form is not filled out.

This also makes a larger workload for the district.

"It's creating a log jam of paperwork, and it's taking away from counselors being able to do their job. It's taking away from nurses being able to do their job. It's just one more pile for a principal," says Byrd. "At some point we've got to stop doing paperwork and start doing what's right for our kids."

If consent is not given the school district is to find an alternative activity for the student.

If medical or mental health services are needed the school district is required to get in contact with the parent or guardian before moving forward.

Byrd says the bill also requires more accessibility to school board meeting and advanced notice for parents.
